The undersigned ROCSP hereby acknowledges that the attached Roll-Off Waste Hauling Permit Terms and Conditions will become part of and be incorporated into the conditions of the Permit upon issuance by the Village of Wellington.
This permit is for Construction and Demolition roll-offs only. Company must complete a Livestock Hauling Permit in order to haul any roll offs containing livestock waste.
SECTION 1: Term: This permit expires each year on September 30th at midnight and must be renewed annually.
SECTION 2: Applicable Law: Permittee shall comply with all provision of applicable law including Chapter 46 of Wellington’s Code of Ordinances.
SECTION 3: Definitions:
A. Service Area: shall mean the area within the incorporated boundaries of the Village of Wellington, Florida, for which the solid waste management and mandatory solid waste collection program is administered as provided in the contract as it may be amended from time to time.
B. Roll-Off Container: shall mean and include any container designed or intended to be mechanically dumped into a loader packer type truck or recycling vehicle. All containers must be of the specifications as designated by the contract administrator, in writing.
C. Construction and Demolition/Debris: shall mean materials generally considered to be not water soluble and nonhazardous in nature, including, but not limited to, steel, glass, brick, concrete, roofing material, pipe, gypsum wallboard, and lumber from the construction or destruction of a structure as part of a construction or demolition project. Mixing of a de minimis amount of waste other than C&D/debris from the construction site will not automatically cause it to be classified as other than C&D/debris
SECTION 4: Services to be Provided: The ROCSP shall have the non-exclusive right to provide Roll-Off Collection Services, as defined herein, within the Service Area except as provided by the terms of the mandatory Solid Waste Collection Program.
A. Roll-Off Collection Service: For purposes of this permit, Roll-Off Collection Service shall mean the Collection of Construction and Demolition (hereinafter, “debris”) of Roll- Off Containers, or the Collection of debris by other mechanical means, within temporary locations in the Service Area, limited to new construction sites, remodeling or refurbishment sites, or vegetative debris.
B. Conditions and Frequency of Service: The size of container and frequency of removal shall be determined by the ROCSP and the customer. However, container size and frequency of debris removal shall be sufficient to ensure that all debris generated at the site fits within the container and that no debris be placed outside of the Container or that Containers are overloaded, and that the contents can be properly covered and contained during transport.
SECTION 5: Method and Manner of Service:
A. Roll-Off Container pick up or delivery shall not occur prior to 7:00 A.M. nor after 6:00 P.M. on any day in a residential area or within one hundred fifty feet (150') of a residential area.
B. Roll-Off Containers shall be in good repair, water tight, substantially free of rust and holes with all hinges and door latches in complete working order.
C. All loads being transported in Wellington shall be completely covered and secured such that no material content of the Container shall be able to blow, bounce, spill, or fall off of or out of the Container.
D. There shall be no service in Wellington on Sundays, except in an emergency declared by Wellington.
SECTION 6: Equipment: Equipment used in Wellington for the collection and transport of waste materials shall, at all times, be in safe operating condition, clean, in good repair, and display the company name and local telephone numbers in letters and numbers at least five (5) inches high.
SECTION 7: Disposal: Disposal of Solid Waste collected by the ROCSP pursuant to this Permit shall be deposited only at Solid Waste Authority of Palm Beach County (SWA) facilities or such other facilities designated by the SWA for disposal of Solid Waste. It is the responsibility of the ROCSP to ensure that such facilities are permitted and in good standing by the SWA. Further, waste collected pursuant to this permit shall be deposited only at locations included in the Roll-off Collection Permit Application form approved by Wellington.
SECTION 8: Spillage: The ROCSP shall not permit littering, spillage or leakage to occur upon any private or public property within Wellington. In the event of littering, spillage, or leakage caused by the ROCSP or employees of the ROCSP, the material shall be promptly cleaned up at the sole cost of the ROCSP within twenty-four (24) hours of occurrence. The ROCSP will also be responsible for all damage to private or public property, including drainage structures, utilities, canals or roadways. The permitted ROCSP also agrees to reimburse the Village of Wellington for expenses incurred for any damages to Village property. All clean up shall be in accordance with all federal, state and local laws, rules, regulations, codes, ordinances, directives and guidelines.
SECTION 9: Revocation of Permit: Wellington may revoke this Permit by giving RPCSP thirty (30) days advance written notice upon the failure of the hauler to comply with the terms of this permit or any applicable federal, state or local law. Further, the enforcement provisions of Chapter 46, Section 43 of Wellington’s Code of Ordinances shall apply.
SECTION 10: Charges and Rates: Charges and rates for service provided pursuant to this Permit are to be established between the customer and the permitted ROCSP.
SECTION 11: Change of Law: This permit is subject to all federal state and local laws, as the same may be amended from time to time.
